 Homeowners and landlords claiming that Uponor Corp. high-zinc “yellow brass” fittings they had installed were prone to corrosion 
and leaks urged a Minnesota federal judge on Monday to grant final approval to a settlement worth up to $21 million. 
Uponor attorney John R. Schleiter told Law360 on Tuesday that the “evergreen” agreement would require Uponor to pay a minimum
of $3 million into a common benefit fund. That fund would provide individual class members with up to $60,000 for residential property damage claims and up to $100,000 for owners of nonresidential buildings. PEX  Brass Failures  

With the sudden increase in the use of PEX in recent years, failures in PEX plumbing systems have been observed. Failures can be linked to two areas; 
the pipe and the fitting. The pipe can fail when exposed to chlorine within the water, or over exposure to sunlight before installation. In addition, PEX pipe 
has also been found to be permeable when exposed to some solutions, including oxygen and some petroleum products, and can leach toxic chemicals 
from the pipe material. As far as the fitting, the leading cause of failure in a brass fitting used with PEX is caused by dezincification. This causes the fitting

How Safe is PEX Piping?
As with any type of piping that will be used to transport drinking water, the safety of the pipes must be evaluated. We’ve already explored the chemical leaching downfalls of traditional piping, but what about PEX pipes? Does chemical leaching exist here as well?  PEX Chemicals 

As a result of this advocacy, the state has adopted an unprecedented set of restrictions on the use of PEX. The new regulations provide measures to 
address: (1) the vulnerability of PEX pipe to permeation by outside contaminants such as gasoline or solvents; (2) the vulnerability of PEX to premature failure when exposed to sunlight; (3) the failure of PEX brass fittings due to dezincification and stress crack corrosion; (4) the potential for traditional 
PEX pipe to fail when installed in continuously recirculating hot water systems; and (5) the potential health impacts from the leaching of chemicals

PEX is NOT Green -  PEX is Currently Non-Recyclable
One of the most significant problems with PEX pipes is that it is non-recyclable. That means, there is no way of getting 
discarded PEX materials back in use. Research is on to figure out ways of effectively recycling this material, which is also 
used in radiant floor heating installation.

On Jan. 22, 2009, the California Building Standards Commission (CBSC) certified the Environmental Impact Report (EIR) on crosslinked polyethylene (PEX) tubing and unanimously adopted regulations approving PEX water distribution systems into the California Plumbing Code, set to take effect Aug. 1, 2009.

Conducted from October 2007 through December 2008, the EIR evaluated PEX tubing on its impact on air quality, water quality and performance, as well as PEX tubing installation, use and disposability and manufacturing processes in the areas of waste, recycling, energy consumption and natural resources.

The EIR concluded the adoption of PEX tubing into the California Plumbing Code with proposed regulations would be “an environmentally superior action with respect to public health and hazards, water quality and air quality.”

In fact, millions of feet of PEX tubing are already in service in plumbing applications throughout California, due to the fact that 180 municipalities and counties within the state have already approved the use of PEX tubing.

What is PEX?

An Uponor plumbing system features Engel-method crosslinked polyethylene (PEX) tubing. This is a flexible plastic tubing product that has been used for more than 35 years in radiant floor heating, plumbing and fire safety systems.

PEX is classified into three categories: • PEX-a (Engel or peroxide method) • PEX-b (Silane method) • PEX-c (Electron beam or radiation method)

The PEX tubing industry considers Engel-method PEX-a tubing superior because the crosslinking is done during the manufacturing process when polyethylene is in its amorphic state (above the crystalline melting point). Because of this, the degree of crosslinking reaches around 85%, resulting in a more uniform product with no weak links in the molecular chain.

The properties in PEX-a tubing make it the most flexible PEX on the market, allowing for the tightest bend radius available — as little as 3½" for ½" tubing. Its flexibility also greatly reduces the instance of kinked tubing. However, because of the thermal memory of PEX-a, if a kink does occur, a simple shot from a heat gun returns the tubing to its original shape.

The shape memory of PEX-a tubing allows it to expand and then shrink back to normal size. This allows for the use of Uponor’s unique ProPEX® expansion fittings, which capitalize on the shape memory of PEX-a to create strong, durable and reliable connections without the use of dangerous torches, glues or solvents.
